1. Introduction & Binding Agreement

This Terms of Service Agreement ("Agreement") is a legally binding contract between you ("User," "you," or "your") and HeyGlow ("Company," "we," "us," or "our"), accessible at heyglow.in. This Agreement governs your access to and use of the HeyGlow web application, platform, AI analysis tools, and all associated services (collectively, the "Platform").

By using the Platform, you represent that you have the legal capacity to enter into this Agreement and are not prohibited from receiving services under the laws of any applicable jurisdiction. This Agreement incorporates by reference our Privacy Policy and Refund Policy.

2. Acceptance of Terms

By accessing or using any part of the Platform, you confirm that you have read, understood, and agree to be bound by this Agreement. IF YOU DO NOT AGREE, YOU MUST DISCONTINUE USE OF THE PLATFORM IMMEDIATELY.

Your use of the Platform also constitutes agreement to comply with all applicable local, national, and international laws. The Company reserves the right to terminate your access at any time for any breach of these terms.

3. Modification of Agreement

We reserve the right to modify this Agreement at any time. Changes take effect immediately upon posting. Material changes will be communicated via email to your registered address or through in-app notifications.

Your continued use of the Platform after any modification constitutes acceptance of the revised terms. If you do not agree to updates, you must stop using the Platform and close your account.

4. Medical & Diagnostic Disclaimer

THE PLATFORM IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. All AI-generated skin and hair analysis, condition estimates, and product recommendations are for informational and cosmetic purposes only and are not a substitute for professional dermatological or medical consultation.

Never disregard or delay seeking professional medical advice based on information from this Platform. If you think you may have a medical condition, consult a qualified health professional or contact emergency services immediately. Reliance on any output from the Platform is entirely at your own risk.

5. No Professional-Client Relationship

Submitting photos, completing questionnaires, or interacting with our AI does not create a doctor-patient, therapist-patient, or any professional-client relationship between you and HeyGlow or its team.

AI-generated insights are based on algorithmic data processing and should not be construed as clinical findings. No confidential professional relationship is established through your use of the Platform.

6. Eligibility & Registration

You must be at least 13 years of age to use the Platform (16 in the EU and certain other jurisdictions). Users under 18 must have parental or guardian consent. By registering, you confirm you meet these requirements.

You agree that all registration information — including name, email, and age — is accurate, complete, and current. You are responsible for keeping your information updated. Inaccurate information may result in account suspension or termination.

7. Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Do not share your login details with any third party.

Notify us immediately at support@heyglow.in of any unauthorized use of your account or any security breach. HeyGlow is not liable for losses caused by unauthorized access resulting from your failure to protect your credentials.

8. Prohibited Conduct

You agree not to: (a) reverse engineer, decompile, or disassemble the Platform; (b) use bots, scrapers, or automated tools to extract data; (c) bypass security measures or access controls; (d) upload viruses or malicious code; (e) use the Platform for any unlawful or unauthorized purpose; (f) interfere with the Platform's infrastructure or other users' access.

You are also prohibited from transmitting defamatory, obscene, threatening, or intellectual-property-infringing content. Violations will result in immediate termination of your access and may result in legal action.

9. Intellectual Property

All Platform content — including text, graphics, logos, UI design, icons, images, AI models, algorithms, and software — is the exclusive property of HeyGlow and is protected by applicable copyright, trademark, and intellectual property laws.

Your use of the Platform grants you a limited, non-exclusive, revocable, and non-transferable licence to access our services for personal, non-commercial use only. This licence does not grant you any rights to reproduce, distribute, or create derivative works without our express written consent.

10. AI & Data Accuracy

Our AI models process visual biometric data to estimate skin and hair conditions. These models are based on statistical probabilities and machine learning, and external factors such as lighting, camera quality, and positioning significantly affect results.

We make no warranty that AI results are 100% accurate, error-free, or representative of your clinical condition. Scores and markers provided — including any "Glow Score" — are comparative metrics within the HeyGlow ecosystem only and carry no clinical validity.

11. Subscriptions & Billing

HeyGlow may offer one-time purchases and recurring subscription plans. By selecting a paid plan, you authorise HeyGlow (or our third-party payment processors, including Razorpay or Stripe) to charge your payment method for the initial term and all subsequent renewals at the then-current rate.

Pricing is subject to change; any price increases will be communicated in advance. All billing disputes must be raised in writing within 30 days of the charge date by emailing support@heyglow.in.

12. Auto-Renewal & Cancellation

Subscriptions automatically renew for the same duration as the initial term unless cancelled at least 24 hours before the end of the current billing cycle. You may manage or cancel your subscription through your account settings at any time.

Upon cancellation, you retain access to paid features until the end of your current billing period. No partial refunds are issued for unused portions of a subscription term, except as provided under our 30-Day Money-Back Guarantee.

13. Refunds

HeyGlow offers a 30-Day Money-Back Guarantee on all first-time purchases and subscriptions. If you are not satisfied for any reason, you may request a full refund within 30 days of your purchase date by emailing support@heyglow.in.

Renewal charges, purchases made through third-party app stores, and requests submitted after the 30-day window are not eligible under this guarantee. Please refer to our full Refund Policy at heyglow.in/refund-policy for complete details.

14. Children's Privacy (DPDPA / COPPA / GDPR)

We do not knowingly collect personal data from children under 13 (or 16 in certain jurisdictions). If we discover such data has been collected without verifiable parental consent, we will immediately delete it and terminate the associated account.

In compliance with India's Digital Personal Data Protection Act, 2023 (DPDPA), we process children's data only with verifiable parental consent. If you believe we have collected data from a minor, contact us at support@heyglow.in immediately.

15. User-Generated Content

By submitting photos, feedback, or any content to the Platform, you grant HeyGlow a non-exclusive, royalty-free, worldwide licence to use, process, and store such content solely for the purpose of providing our services to you.

You retain full ownership of your content. We do not sell or share your photos or personal content with third parties except as described in our Privacy Policy. You are responsible for ensuring any content you submit does not violate the rights of others.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HEYGLOW AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE PLATFORM SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO HEYGLOW IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR ₹500 (FIVE HUNDRED RUPEES), WHICHEVER IS GREATER.

17. Indemnification

You agree to defend, indemnify, and hold harmless HeyGlow, its officers, employees, agents, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from: (a) your use of the Platform; (b) your violation of this Agreement; (c) your violation of any third-party right; or (d) any claim that your content caused harm to a third party.

18. Governing Law & Dispute Resolution

This Agreement is governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India.

Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for a period of 30 days. If unresolved, disputes shall be submitted to arbitration under the Arbitration and Conciliation Act, 1996 (India).

19. Termination

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for conduct that we reasonably believe violates this Agreement or is harmful to other users, us, third parties, or the integrity of the Platform.

Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination — including intellectual property rights, disclaimers, indemnity, and limitations of liability — shall continue to apply.

20. Miscellaneous

If any provision of this Agreement is found to be unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

This Agreement, together with our Privacy Policy and Refund Policy, constitutes the entire agreement between you and HeyGlow regarding the Platform and supersedes all prior agreements or understandings on the subject matter.
